A Civil Code in Myanmar: Opportunities and Challenges - Legal Workshop

On the 29th February 2020, The Institute of Research on Contemporary Southeast Asia (IRASEC- CNRS), represented by Director Claire Tran and Dr. Rémi Nguyen, in conjunction with the Centre Innovation et Droit (Faculty of Law, University of Burgundy) organised an international legal workshop welcoming renowned professionals from Myanmar, France, Malaysia and Vietnam at Novotel Yangon Max.

Sponsored by MLR COMPANY LIMITED, IQ VISION AND SEA LION GROUP, this workshop dedicated to the following topic: A Civil Code in Myanmar: Opportunities and Challenges – A comparative perspective, has seen the attendance of over a hundred of professionals, among them members of Law Departments from Yangon University, East Yangon University and Dagon University, LGAM Legal Association.

In his opening speech, special guest Dr. Maung Maung Thein, Former Deputy Minister of Finance and Executive Chairman of Zico Law Firm suggested that “Myanmar should take into consideration the tool of codification in order to modernize its Law.”  

The opening followed by the thanks of Director Claire Tran towards participants and attendees and concluded by the presentation of the different projects of IRASEC in Southeast Asia. 

On the occasion of the 1st session, while giving a presentation of Myanmar legal history Dr. Rémi Nguyen advocated in favour of the opportunities related to an adoption of a civil code meanwhile Prof. Myint Zan pointed out challenges and obstacles of such endeavour.

The 2nd session, led by Prof. Michel Grimaldi (Pantheon-Assas Paris 2 University), highlighted the French legal culture in a presentation of the advantages and disadvantages of a Civil Code.

During the 3rd session, Former Vice-Rector Prof. Nguyen Ngoc Dien and the Dean of the Faculty of Law Prof. Nguyen Hong Nhung (University of Economics and Law - Vietnam National University in Ho Chi Minh City) shared the use of a Civil Code through the Vietnamese Experience and underlined benefits of the Vietnamese Civil Code as a compromise between tradition and modernity.

The last session was concluded with following topics: Practicing Law in Myanmar: International Lawyers Perspective where Mr. Eddy Jabnoune (Audier & Partners Myanmar) presented the practical challenges of codified Myanmar Contract Law while U Myo Win (Myo & Myo Law Firm) pointed out challenges of Commercial Litigation in Myanmar.
